1. General

These terms of use apply to the services of mp3referat.com. These terms of use are accepted with the download,installation or other use of page content. Statutory regulations shall fully apply independently of these regulations.


2. Scope of use

The content provided by mp3referat.com is intended exclusively for private use. Any other form of use, especially commercial use is normally forbidden without the relevant legal permissions having been granted by the rights holders concerned and/or mp3referat.com.


3. Upload and acceptability of content

In principle the content offered by mp3referat.com is prepared and determined by the users themselves. The upload of material and the process of making it available for use is fully automated. There is no right that users possess that uploaded content will be accepted by mp3referat.com. mp3referat.com reserves the right to remove content at any time without giving any reasons.


4. Quality of content

mp3referat.com does not guarantee the correctness of the featured content. Users are required to evaluate the content and thereby ensure user supported quality management. Evaluations will be purely subjective, being self-organised. The evaluations do not represent the views of mp3referat.com. mp3referat.com will endeavour to reject contributions of inferior quality.


5. Legal permissions

Users grant mp3referat.com rights of use in respect of the uploaded contents, including the right to make the content available. This right of use includes the download of contributions in mp3 format offered by mp3referat.com. The declarations of acceptance contained in the users’ declarations of intent and necessary for the granting of legal permission to mp3referat.com, are deemed to have been given when the uploaded content is placed online by mp3referat.com. Users and rights holders who upload content receive no compensation for legal permission.

All users are required to check, before uploading, whether they own all the necessary rights to make content available on mp3referat.com. Users, who infringe such intangible property rights, will be excluded from mp3referat.com’s offering and prosecuted. mp3referat.com will act timeously after being advised of illegal content, by checking the affected content. If mp3referat.com should be approached by a third party due to a user’s uploaded contents, then the identity of the user responsible for the uploading of the content will be established and he will be held liable. Any act liable to prosecution in the context of the use of mp3referat.com will normally be reported to the police authorities. This is particularly valid for the distribution of extremist content. The upload of music is strictly prohibited. mp3referat.com reserves the right to report infringements to trade associations in the music industry.


7. Final provisions

Should any individual provisions of these terms of use be ineffective, the other terms of use remain in effect. Accordingly, an interpretation of the provision concerned will be chosen which is as close as possible to the ineffective one.
